Summary
State administrative law is a difficult topic based on the three branches of government and the role each plays in administrative law. In Pennsylvania, the rise of administrative agencies beginning in the 1930s has resulted in multiple agencies, just as in all states. The development of administrative law has grown dramatically in the last fifty years. First, the passage of the Commonwealth Documents Act (1968) creating the Pennsylvania Bulletin and Pennsylvania Code made it mandatory for the publication of proposed and final regulations on a timely basis. Second, the creation of an intermediate appellate court to address administrative law cases in both original and appellate processes is unique in state court jurisdictions. The Pennsylvania Commonwealth Court, begun in 1970, now has a fifty-year history of case law. This book brings together a wide range of primary and secondary sources dealing with Pennsylvania administrative law. It contains a detailed review of administrative law in the state, using both statutory and administrative law sources; explains how to research current, proposed, and historical regulations; and provides a detailed description of the rule-making process in the state. The guide also contains a useful bibliography of secondary sources on the topic, including encyclopedias, treatises, CLE books, and periodical articles.--Publisher.
