Summary
Estimates of how much American enterprise is hemorrhaging to Chinese interests through intellectual property theft ranges to as much as US$600 billion annually. Continuing breaches of these proprietary interests have managed to unify the otherwise deeply divided political parties in the United States and rally international interest in seeking redress. The emerging consensus would do well to pause to consider the complications involved with any given option in moving toward a resolution. Businesses that take a firm stance on protecting their rights to patents and copyrights risk being excluded from lucrative Chinese consumer markets. Governments that leverage their power to resolve the matter face the inevitable prospect of retaliatory action of some kind as China and the United States maneuver to advance their own political and economic interests. This case study offers a survey of two broad approaches to balancing competing interests, one assertive and the other accommodationist. Within the more proactive assertive approach, lawsuits and trade restrictions are explored; for the latter, concessions and strategic decoupling are offered. Thus there are four types of tactics. Within the backdrop of these four tactics, students are asked to weigh the competing concerns of individual corporations, government, and a population comprised of people who are simultaneously consumers and producers of goods and services.
